1. Scope

These Terms and Conditions (T&Cs) apply to all contracts concluded between me, Moritz Piontek, Dorfstraße 36, 17379 Rothemühl, and my customers through my online shop. Deviating terms and conditions of the customers will not be recognized unless I expressly agree to their validity in writing. I sell exclusively to private individuals.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order. By clicking the "Order with obligation to pay" button, you submit a binding order for the goods in the shopping cart. The contract is only concluded when I confirm the order via email.

3. Prices and Payment

3.1. All prices in the online shop are final prices and do not include VAT, as I apply the small business regulation under § 19 UStG.
3.2. Shipping costs are charged additionally and are clearly indicated in the product description and during the ordering process.
3.3. Payment is made via advance payment, PayPal, or other payment methods specified during the ordering process.

4. Delivery

5. Right of Withdrawal

Consumers have a statutory right of withdrawal. Details are provided in the withdrawal policy.

6. Retention of Title

The goods remain my property until full payment has been made.

7. Warranty and Liability

7.1. The statutory warranty rights apply.

7.2. I am fully liable for intent and gross negligence. For simple negligence, I am only liable for breaches of essential contractual obligations and limited to foreseeable, typical contractual damages. Liability for indirect damages, such as lost profits, is excluded.

7.3. Liability for damages resulting from injury to life, body, or health remains unaffected.

8. Dispute Resolution

I am neither willing nor obliged to participate in dispute resolution procedures before a consumer arbitration board.

9. Final Provisions

9.1. The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

9.2. Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
